SCS SB 394 -- CERTAIN BUSINESS NAMES SPONSOR: Ridgeway (Ervin) COMMITTEE ACTION: Voted "do pass by consent" by the Special Committee on General Laws by a vote of 11 to 0. This substitute allows a person to use a historical name to refer to a building, structure, or business such as "drugstore" or "pharmacy" if he or she does not engage in the practice of pharmacy. The Board of Pharmacy will retain the authority to prohibit persons who sell a naturopathic or homeopathic service or any herbal, nutritional, vitamin, dietary, mineral, or other supplement intended for human consumption from using certain terms to describe themselves or their businesses. FISCAL NOTE: No impact on state funds in FY 2010, FY 2011, and FY 2012. PROPONENTS: Supporters say that the bill will allow a well-known restaurant to retain its historic name. Testifying for the bill was Senator Ridgeway. OPPONENTS: There was no opposition voiced to the committee. OTHERS: Others testifying on the bill say that the changes to the law are acceptable.
